Subletting your home
If, as a leaseholder, you let your home to someone else, then this is called subletting . Under the terms of the lease, you are required to register all sublets within 21 days of the sublet commencing. CPH has no objection to you subletting your property as long as you keep us informed to enable us to access your property and contact you. Failure to inform us that you are subletting your home risks breaching your lease. It is vital that we have up to date contact details as we may need to access your home to carry out emergency repairs. Furthermore you are responsible for your tenants complying with your lease agreement with us. If we are unable to contact you as we don’t have your details we may have to take legal action against you. If we don’t have up to date contact details you may not know if you’re in arrears with your service charge payments as you may not be reading the letters we send to you. This could result in us writing to your mortgage lender or applying for a county court judgment against you, actions that may be avoidable by providing us with your contact details. As your landlord we would prefer to have a transparent relationship with all our residents to avoid such outcomes.
If you are subletting please send us:
- A certified copy of the tenancy agreement with the sub-tenant.
- A registration fee of £25.00 + vat.
- An alternative mailing address so that the accounts (and any other formal notices) can be sent directly to you.
- Details of any managing agent.
- A contact number for you and your managing agent, if you have one, in case an emergency arises.
- A copy of your Gas Safey certificate – by law, as a landlord, and as a leaseholder, you are responsible for making sure that gas fires and boilers are kept in good order and checked for safety at least every 12 months. You must keep a record of these checks, which must be carried out by a Gas Safety registered contractor.
- A signed and returned deed of covenant which protects both your and our interest in your home.
Please note that this requirement applies whether the property is sublet to an individual or to an organisation such as a company, a registered social landlord or a housing association.
If an existing tenancy agreement with your sub-tenant is renewed you will not need to pay a further registration fee. In this case, we only require a certified copy of the renewal of the tenancy.
Please note that CPH will not allow you to sublet within 12 months of a Right to Buy unless you can demonstrate exceptional circumstances.
