Thinking of selling your home?
If you are selling your home, the buyer's solicitor will request a resales and assignment pack. Please note that under the Data Protection Act, we can only supply this pack to you (the vendor) or your representatives. It is normal practice for the solicitor acting on your behalf to request this information from us. Our fee for this comprehensive package of information is £115 (£100 + VAT). Upon receipt of the cheque we will issue a resales and assignment pack within five working days.
The information in this pack includes:
- Statement of Account for service charges.
- The most recent request for payment made by or on behalf of the landlord in relation to service charges, ground rent and buildings insurance and covering the 12 month period pre-ceding the date the property was put on the market for sale.
- The name and address of the current landlord.
- Schedule of the last three years’ service charges.
- A summary of works and proposed works affecting the property and expected recharges.
- A Deed of Covenant for re-sales.
What happens next?
Should both parties agree to the sale, the buyer’s solicitor will ask for a Notice of Transfer and Charge on completion. Please note that CPH cannot, however, grant Notice of Transfer and Charge (i.e. recognise the new leaseholder/assignee) unless your service charge account is cleared at completion. You must ensure that all outstanding service charge payments are made to CPH before selling your property but you may make an arrangement between yourselves with regard to how you settle future payments or charges.
What if I bought my flat in the last 3-5 years?
If you sell your flat within three, or five years – depending when you bought it from either Lambeth Council or CPH under the Right to Buy scheme – you will usually have to pay back some, or all of the discount given to you when you bought it. The exact terms are set out in your lease. If you applied to purchase your home on or after 18 January 2005 and you wish to sell within 10 years of completion (the date on the lease) then CPH has the first right of refusal to buy back the property.
